But to this purpose the provision made by this section
seems but indifferently adapted.
As to the Commander, that after by whom a
friend or dependent of his for to whom it is his desire
to render service, and in whom he thinks he can
without imprudence venture to repose the requisite confidence, and
who in virtue of §. will have given the ordinary
and necessary security, that as soon as the time
comes for vesting the money in those chosen hands
he should of himself be forward in making application
to the Judge to compel this confidential
friend of his own – to afford the extra security,
having arisen between himself and this friend
seems not to be much in the order of things, a very
natural incident.
Nor yet, unless in case of an accidental quarrel disagreement
does it seem very natural that by
any other person interested other than the Captain any
such application should be made.
As to any person other than the Commander, to
any such person no such power is given by this clause, at least the at least of the clause.
Under the denomination of Captor one single
person is the object and the only object which at the time of penning
this clause the draughtsman had in view: the captor
is the word: and to with this description it is the Commander
alone that if any person did, could agree.
Unfortunately this person the only person to whose
interest the care of the legislator has here any direct
application is the very person of all others persons, to in whose
instance the demand
for any such care
is at its lowest pitch.
