The natural state of things course of the business is that the for the Commander an Agent
shall be appointed by the Commander: and that though
there are three classes of persons besides each of whom is
enabled to appoint its own Agent† † Act 1805. §., ye that these three
classes shall all of them acquiesce in the choice made
by the Commander, and thus that the Agent for the Commander
shall be the Agent for all under his command.
Thus far where it is by a single vessel that the capture
is performed: but if it be by a number of vessels together,
especially if so circumstanced that in the production of
the fortunate result no one vessel could be said to have
contributed a decidedly greater share than the rest, then that
an Agent should shall have been there, by the concurrence of
all the commanders interested.
Let us take the most simple case, viz. that in which
one Agent, appointed chosen by the Commander alone acts for the
whole ships crew.
In this case a mischief which it is plain from
a several passage in both one of these Acts , and as well as from what one intimation
given by Mr Rose, is – that of the Commanders
taking g too good care of himself, leaving those who
are beneath him to the mercy of a negligent or rapacious
Agent those who are beneath his inferior co-partners the inferior classes. For what else
can have been the origin of the Section clause forbidding any
participation of profit between the Agent and anyone else?
all other persons to take any share in the profits of the Agent?
