In the inferior classes, one or more of them – in those there
are to be found the persons in whose instance a real
demand for need of the security meant to be afforded by this Section
is by much most likely to take place.
But the making as towards the Commander, to
make any such requisition, on the part if any person
subject to his command a most very invidious and extreme unpleasant
at least, if not dangerous task operation. I implies a suspicion
applying at any rate of a to the favoured object of the Commanders
choice and thereby a censure upon if not a dismiss
of the Commander himself: if the Commander himself
does not think fit to make any such requisition, on
the part of anybody else the making it is little
less than an act of declared hostility to against the Commander.
In these circumstances, out of ten cases instances
in which the demand for need of such requisition takes place it
seems as much if in so much as one any such requisition should it really happen
to take place be made.
If the demand for such security be real and frequently
exemplified there is but one course arrangement that promises
to render it efficient: and that is for to make it a
matter of duty to the Judge himself to originate the
business: for example at the time of passing condemnation
to address himself in open Court to the shame parties interested or their
Proctors Judicial representatives, having what they know as that
concerning the value of the prize capture, and calling upon the
Agent or Agents to give by their own bond at least such
extra security as the extra value of the capture points out is
reasonable: adding such collateral security, if any as can be obtained.
