But in every part of the Act the supposition is
is that the of the proceeds of a prize it is not upon the
whole that can be distributed distribution can take place: and that accordingly there
will always or at least generally remain a part more or
less considerable, which not finding at the present at least finding nobody to demand it, must
for a time be disposed of somewhere else, and is accordingly
ordained to be transferred to Greenwich Hospital.
Yet with On all other occasions the two operations are
supposed to go on, and that be without need of interference on the part of the Judge, the one after the other
in the first place the distribution of so much as can be
distributed, in the next place the transmission transference of the
undistributable remainder: and in the ordinary course of the business this without need of
interference on the part of the Judge.
Yet here if the so it be that in pursuance of the power
here given to him, the Judge interferes in the business, it
is but one of the two operations that measures can be taken he can take measures for
the performance of. If distribution of ever so small a
portion distribution be made on the spot, nothing can be
done for the Hospital, nothing at all consistently with the wording
of the Act can be done with the undistributable remainder.
If any part be remitted to the Hospital, it
must be the whole, and though the whole body of the persons
entitled should every one of them be present on the spot
and calling for it, not a penny can any one of them
be suffered to receive there.
