Act 1805 §. 17. In this Secti Into the compass of this one
Section are found those perfectly distinct provisions
two of them of comparatively minute extent, the other of
immense and all-comprehensive amplitude.

1. In the first, power is given in every all cases, ... in which
"the regular time of Appeal is classed, or in which the
Appeal hath been determined" ... power is given to the High Court to make an order for
production and verification of Accounts, and for the distribution
of the Proceeds, and to enforce the same by the
Process of the ... Court by and Attachment
upon the Agent ... in whose hands the Proceeds may be
lodged, or any other person whomsoever to whom such
Proceeds may have been committed, and likewise by
further process against the Sureties of the said Agent ....

2. In the second part, which, lest far from the sentence
should be too short not be long enough, sufficiently long winded,
the draughtsman, hath as usual has entangled in the first,
the like power is given to "any Court Vice Admiralty Judge
"of any Court of Vice Admiralty abroad", in case of
"his having received "any certificate from the Judge
"of the High Court .... of the time of Appeal being elapsed
"without further prosecution, together with an Order
"of Distribution thereupon."

If the time for Appeal has elapsed. – Good: but
suppose the Appeal determined, and the property to be
still lying within the reach of the Vice Admiralty Court in
question undisposed of, – does not is distribution an operation
less necessary to justice, than if it were within the immediate
reach of the High
Court that the property
remained lodged?
