Prize 1808 1809 §. 71
In The last part of this same Section is afforded a remarkable
enough item to be added to the cop numerous instances multitudinous exem
exemplifications afforded that present themselves of the sort of case and method
and extent of Court attention circumspection with which the business of legislation is
performed executed throughout the whole course of this consolidation consolidating
Statute Act.
"And all Courts of Vice Admiralty in America
" and or elsewhere are hereby empowered directed
"and required to enforce upon all persons within their
"jurisdiction all such Orders, and all other Orders
"of the High Court of Admiralty, whether relating to Prizes
"or to any other matter of thing relating thereto,
"within their respective jurisdiction."
A power to this effect – a power with the correspondent obligation – had it not been already given?
what enormous negligence in the whole system of prize
law, and on the part of every person in either House
that has had ever had any concern in it? what enormous negligence that either by office or
by practice had had any ever received a special call to apply his mind
to it!
Was this power any A power to this effect was it
already in existence? Here then is so much an useless
and wantonly and ignorantly inserted mass of surplusness.
But suppose it necessary, what a place to put it
in! who would here have looked for it? To find out whether
any such power whether any such obligation for such it is was or was not in existence who is there
to whom any such thought could occurr as that of searching raking
into this Section for the chance of discovering it?
