7 Jany 1811
§ 89
7. As to the event in question – On the return of each any
one such Vessel having the of which as above described, let
the all claimants every claimant whose shares share have thus been transferred
to the Hospital have it in power his power to receive
payment of it there so it be within the length of time here marked
out: such is probably the meaning provision in which if
put to him in plain terms the penner of this clause
would probably be not disinclined to acquiesce,
acknowledge or at least to adopt. But by addint
plural to singular, – first in the case of expression found for the Ships capturing, then in the case of the Ships captured, such av
mess has been cooked up that doubts would may be seen crawling out of it
in the usual swarms.
The investment above mentioned is to continue (it is said)
"till the release of the ship or ships, by which the
"Captain or Captains shall have been made, for the
"benefit of the Captors: and in the return of any such
"Ship or Ships" then it is that the person in question
"is to cause such proceeds" and so forth, "to be distributed",
and so forth.
If on the occasion of this Act the words
were to be resisted trusted to in the of the sense in doubt
amongst others would here be, whether if or sometimes in
case of a squadron will sometimes happen that be were twenty
ships concerned in the cap taking of one prize, the return
of the last of these co-capturing ships would not be to be
waited for before the process of distribution could commence. But in
the hand of the Judge is a sword by which all doubts that that
can not be disentangled can at any rate be met.
