§ 89

As to the need and use of any such determinate of delay One example will stand in the place of many.
A vessel sends in a prize to be condemned in the High Court sold at the London Market.
The prize is sold accordingly. But before the distribution
commences, whether it could have commenced
certain or no, the vessel the capturing Vessel with all the captors in it (but long after the day for commencing it has under § 73, been advertized) is ordered to the East Indies.

by the Treasurer to pay in to the Hospital the money
which by the supposition he has in readiness by a
and day, by which day if it be not accordingly
paid in, the extra interest as provided by
§. 109 ought to run.

Such is the so frequent result of those fixations of men which
with so little consideration and so much practical inconvenience
are in such abundance scattered through the texture about a
the Statute-book: on the surface correctness regularity,
prudential care: at the bottom inconvenience, inconsistency
and thoughtlessness: under the appearance mask of dispatch,
delay is introduced and seated.

If without any such inflexible postponement delay, the time
were left to the discretion of this public trustee, the infinite variety
of combinations and modifications resulting from times time
distances and space and accident would find in that discretion an
instrument capable of adapting itself to them all. But
to any such set of modifications no fixt time or set of
fixt times drawn by the hand of the legislator applying
itself immediately to

thing like general
propriety adapt itself.
