3. In the case in which where the character in which the applicant
presents himself as that of a the sort of representative
whose principal is his considered as being deceased, the
sort of evidence required is either composed of evidence
of the death, coupled with with the addition with that of the requisite relationship of the
applicant deceased person who might have entitled to become claimant or rather in this case
person entitled, or else with that of the fact of his
having himself made appointment of a some person to
act for him in the character of a representative of the this sort
description here in question.
In neither of these cases does the nature of the case
afford any room for that sort of evidence of title which
in the two preceding cases is constituted by the assertion
of the claimant himself.
Not that in these latter cases it follows that the
assertion stated as above to be requisite in those two former
cases is needless. For without on the existence of such assertion on the
part of the a claimant of and he a claimant justly
entitled depends in those cases the title of the applicant
is in those cases that case altogether dependant. If by a
person asserting himself to be of the number of those
whose title to a share in the mass of prize-money
is in question is recognized by the prize list, the
authority in question was not given it is impossible the applicant
can not by any possibility have any good just title to receive the money
which he applies for: whereas in the case where
death is of the number of the cases of which
the title to the money is composed, so as the act of the death be
but sufficiently established, and in the character of representative the title of the applicant
by relationship or appointment established likewise, in
this case if it be rendered
sufficiently clear that
the deceased person in
question were of the
number of those whose
names have place in
the prize list, the title
of the applicant in the character of his representative post mortem is not exposed to doubt admitts not of any doubts.
