1805 1809: 1805 §. 104
Act. 1805: Section 104.
With an interval comprized of no fewer than seven intermediate
sections intervening after subsequently to the one last mentioned brought
to view comes this 104th Section the bearing upon a
case the relation place of which to in the above set of cases
has already been brought to view.
It is that where wheresoever be the immediate source of
payment and the station local situation of the applicant, the character
in which it applies is – not that of a claimant the sort
of claimant in question but that of the a representative post mortem obitum of such a
claimant.
"The prize money to the Representatives of Petty
"Officers, Seamen and Marines deceased, shall be
"paid" (it says) but by whom it does not say "only to those representatives – their
"lawful Attorney or Attornies, upon production of
"the Cheque" to be granted by the Inspectors of Seamen's
"wills".
Short as this Section is, its shortness has
not been able to secure it from guarantee it against the being involved enwrapped
in obscurity and ambiguity of the deepest cast.
How is some restriction meant to to be applied – but and
what is that restriction? how is something some practice of other meant
to be forbidden: but what is that practice. How is some
real or supposed inconvenience meant to be obviated: but what
is that inconvenience.
To these questions or any of them should any
answer be found by anybody it must be from some
other extraneous source: – it will not be from the Act.
