But what would be have been preferable, in keeping the passage
more effectually clear not only of ultimate and permanent
ambiguity which is ends productive of litigation
of which the solution can not be add had but at the expence
of pounds instead of pence and months instead of
minutes but that soluble ambiguity which ends
in nothing worse than or the unpleasant sensation
produced by unaptness and indigence of language
would have been to say shall not be paid to their
representatives and so forth, but upon production of
the cheque and so forth.
As to the purport and matter of this provision Section, what
is the nature and tenor of the instrument thus spoken of under
the technical and mysterious denomination of a checque
is among the things that ought to have been but are not to
is not to be learnt from this consolidating Act.
But be it what it may in the character of a separate
document prepared for the use and information
of him the official person on whose determination payment depends, prepared
by another and distant official person, it may
without much danger of error be pronounced useless,
and if useless much worse than useless.
To pronounce this judgment requires two additional principles
of reasoning other than those already employed brought forward as above.

personal examination of a claimant himself i.e. of the
individual by whom the service thus meant to the remunerated
was rendered a written instrument is trusted to one
person to pronounce judgment on the genuineness of it is better than a
