As to the consideration by which in the character of reasons
the prohibition here denounced established had recommended
itself for adoption to the legislator, for a these of course
are not given. "Whereas" is the adverb employed
to the office of which it belongs to introduce such
observations as are meant to be presented in the character
of reasons: but it would be theoretical and unparliamentary
to present in that character any an observation from
which any the slightest smallest particle of instruction were
extractible. Whereas it is expedient – whereas doubts
have arisen.

In this case however the reasons do reason does not seem
to be very deep beneath the surface.

The relation which the Greenwich Treasurer and
any person acting under his direction bears to a Prize
Agent is of the partly that which a Judge Prosecutor bears
partly that which a Judge bears, as towards a suitor:
or more generally that which a superordinate bears
as towards a subordinate. With reference to each
other, the two situations are of the number of those pairs
of situations the units of which in so far as regard to justice and
good government has any place prevails are carried with relation
to each of other considered as incompatible. The incongruity
is of that sort which has would have place where as often as
a member of the executive department, or the
member of a Judicatory which has no judicatory over
it but Parliament has possesses a vote in either House: acting
thereby as Judge over himself and in his own cause,
in either of those
in which
alone in case of
misconduct it could
happen to him to behold
either a prosecutor or
a Judge.
