Prize 1805. 1809: 1805 §. 94
Singular enough is the sort of incongruity this thus
transpires.
Here in this Section are so advanced a part of
the Act as the 94th of its 123 Sections power is given
inform to the Official person in question to appoint
for the purposes sort of business herein begun to be stated, deputies at
wherever he pleases to act for him within the
Kingdom. But in and by a prior an anterior Section
it appears that to with Deputies for the transaction
of such business in it pleases him then to transact
he is already somehow or other provided all over
the world over. By the observation Observing that in the opinion of
this legislator it is then virtually declared to be necessary
that to warrant that official person to appoint
Deputies for transacting business under him within in places a place
the kingdom it was necessary for him to have special authority
so to do from Parliament, I was thus sent of course
to hunt over those in 123 Sections contained in those
80 folio pages for the purpose of finding the Section
in which this the like power was given to him to be exercised
neither in other parts of the globe. But in no
Section part of the Act either anterior to this 94th or posterior
to it have I been able to find any such provision.
Warrant for the exercise of the lesser power, necessary:
warrant for the greater because greatly more extensive
power not necessary: such is the incongruity
presented by the loquacity of the legislator on the one
occasion compared with his silence taciturnity on the
other.
