Even in the denomination given to this most simple
business – the sort of business that is to be performed
in an Office of the sort in question, the genius of the
legislator has contrived to introduce ambiguity and
confusion obscurity – "Paying and refunding:. An issue
is to be kept open for the purpose of paying and refunding.
Would it not be imagined any one imagine that here even two distinct
businesses or operations meant to be spoken on – to one
of which the denomination of paying could alone be with
propriety applied – the the other the denomination of
refunding? Let him look on to the 13th Section
from this – let him look at §. 95 and he will
find that there is but no more than one such operation was in contemplation in the case:
that for that one operation the word paying was a
proper name denomination refunding not only an useless but an improper one.

If you were to know that From On reading that the Treasurer
was is to refund money to a Seaman you the natural
supposition is that it is from this Seaman that
he the Treasurer had has received the money which is so
to be refunded. No such thing: – that such is not the case.

As if to thicken the confusion already indicated,
immediately after, comes the word jointly: "and shall
jointly pay and refund such shares, when demanded",
