Prize 1801 1809 1805 § 25
Act of 1809: p Section 25.
In the course of this Section the taking up
the subject of fees, the legislator draughtsman takes occasion to
inhibit the extend to Chelsea Hospital the regulation
by which in speaking of Greenwich Hospital
persons employed in that Hospital.
Not now as elsewhere the tail, but a portion of the bosom belly bowels
of the Section is here occupied by this business: "the modes
and by a sort of careless hasty side stroke the species
of supposed fine here in question are swept into the
penal net: the modes and regulations directed by
"the same Act, for refunding" and so forth, "and for
"facilitating the payment" and so forth, "and preventing
frauds" and so forth, "shall be pursued .... for refunding
"shares of Prize Money paid into Chelsea Hospital, and
"facilitating" and so forth, "and preventing Frauds" and so
forth, "and under the same penalty for receiving any
"fee or reward for remitting or paying any such money
"from Chelsea Hospital".
Shares to be refunded, payment to be facilitated,
frauds to be prevented and so far as penalties are concerned – how? by what means? by
penalties annext to the non refunding of such shares –
to the non facilitation of such proceeds payment – to the non
prevention of such frauds – but under a penalty
for the doing a distinct forbidden act, viz. for receiving
any fee or reward for remitting or paying
and so forth. Howsoever it may have been with regard
to the ideas will themselves, the expression given to them by this
language seems not altogether quite so clear as one is inclined to wish might have been wished.
