More flexible than the invariable never-changing forfeiture, the extra
interest, which it might be in the power of a Judge
to strip of its efficacy by calling it penal interest has
not yet flexibility sufficient for the purposes of justice.
In this country – yea even in England – of mercantile
men, if the view taken and given by the Right Honourable
author of the amending Act be any think like a
correct one, Brief Examination &c there are some that make 12 per cent of
money, there are others that make 15 per cent: and
this upon an average, which as it supposes less in
some instances supposes proportionably more in others:
and thus moreover this in the whole mass of an act each
mans capital fixt and circulating taken together, therfeore
much more upon any given portion of circulating
capital taken by itself.

But to go no higher than 15 per cent, to him who
makes can make 15 per cent of money, 12 per cent call it
extra interest call it penal interest is not a punishment
but a licence: money paid for purchase money of the licence, 12
per cent, neat profit hereupon, 3 per cent.
