Penal CodeCh. Jurisprudential Entities
Possession. "Better"(says a maxim of the old Roman
called Civil lawyer Law.) Better meaning in comparison of
that of any other person is the condition of the possessor,
better: that his condition that is to say better the ground
and reason which a person in his situation is able to make
for the enjoyment of the thing than any that can be made
by anyone else.
Of this notion the propriety case and reasonableness of
this notion scarcely by anyone who hears of it his fear or awe from being learned can a sort
of feeling fail of being entertained perceived: by no one, even of the
most learned has expression it is believed been ever
given to it. This omission gap the greatest happiness principle
and that alone can supply. In case of loss of the possession
he who has the possession would feel no more pain privation
or any regret more acute than a man of the same turn
of mind whose expectation of obtaining it thus stronger than
the possessors expectation of keeping it would in the event of
his failing to obtain not obtaining possession.
Of so many hundred millions of persons each
of whom in case of his having had possession of the thing and then
lost it would upon the losing of it have felt a certain pain
in a certain shape proportioned to the value of the thing not one
feels pain in any shape at the thoughts of not having it: not
one of thembut might fall feel pain in the shape in question in quantity more or less
considerable, if after having the thing in his possession, he was without
receiving or expecting any equivalent for it he were to cease to
have it.
