continuing to confine and employ all
Prisoners remaining at the time of the decease of
the such such Survivor as aforesaid upon the same
terms and conditions as the said Jeremy Benthan
is hereby bound to confine and employ such Prisoners, and to wit
untill his Majesty shall have been pleased to appoint
a Governor or Governors in lieu of such
Survivor, or untill other the pleasure of his Majesty
in respect of the disposal of such Prisoners
shall have been made known: and in default
of such Feoffee or Feoffees so appointed, such seizure
and possession as aforesaid shall be permitted
to remain and continue in such representative or
representatives as aforesaid, in and the value of upon the same terms and
conditions as aforesaid: the value of
such Buildings improvements and stock to be
settled by two Referees, one to be appointed
by the said Lords Commissioners for the time being,
the other by the par such representative or representatives
as aforesaid, with power to appoint an
umpire.
