annuity or annuities without being engaged to serve
as aforesaid or to be engaged to serve as aforesaid without
receiving such annuity during the term of such his
proposed engagement, the said Governor & his said
Successors respectively paying such late Convict or Prisoner."
Should the provision as thus worded appear not to
be sufficiently explicit, Mr Bentham begs leave to
refer it to Mr Soll:r Gen:l to perfect it upon whatever
plan may in his judgment be most equitable. Mr
Soll:r Gen:l will judge whether the doubts that might
result from the want of exact coincidence in point of
time between the expiration of the service and the
commencement or rather the time for payment of
the annuity would be worth obviating at the expence
of the words that might be deemed necessary for
that purpose. The intention in that the quondam
Prisoner may not for a single day have ceased to
enjoy the one provision without being in the actual
enjoyment of the other.
Mr Bentham takes the liberty of concluding with
an humble request, that unless there should remain
any point in relation to which he should deem it
absolutely necessary to call upon their Lordships for
a fresh decision he would have the goodness to
clear the draught from all queries & observations expressive
