Art 1. §. 6. The clause binding the Contractor to execute the building
part of the Contract to the "satisfaction and good liking" of a
nominee of the Treasury was first not stipulated for by the in the Minutes sent
Secretary to the Treasury to but inserted by the Sollr from thence but inserted by him without the of previous communication with Mr Bentham, Mr
Bentham though not perfectly satisfied with it as it now stands,
thus preferred letting it pass sub silentio to the danger of raising up
fresh delays. He profits merits however by the present opportunity with which he is now indulged to submit
it to Mr Sollr Genl: whether in case of difference there is would not be
so a fair ground for a reference in in relation to this point, as well as in
relation to the points mentioned in the 15th & 28th articles, & many 14th-17 & 21st 17th Articles particularly
the 21st articles. Taking the expression from those articles the 21st
as settled by Mr Sollr Genl the proposed addition might stand in some such words as
these, viz:
"Provided that if any dispute disagreement should arise between the said
Jeremy Bentham his Heirs Exors Admors or Assigns on the one
part and the such person or persons so nominated as aforesaid
on the other the same shall be adjusted by two referees
one to be approved by the Ld High Treasurer or Lords Commrs of the
Treasury for the time being and the other by the said Jeremy Bentham
his Heirs Exors Admors or Assigns and in the case such referees shall differ
in opinion they shall appoint an umpire whose decision shall be final.
