Without such clause of reference Mr Bentham with his whole property
would lie absolutely at the mercy of a person or persons altogether
unknown to him, to be nominated, either perhaps indeed, by the present
Lords Commissioners who are known to him, or but perhaps also by their unknown
successors.

As to the non appearance of the principal clause (that for the ex-parte
It seems not (altogether) to suppose that on the minutes, Mr B is inclined to flatter himself that the knowledge which Mr Pitt and Mr Long had of Mr
Bentham's
his plans by from the inspection of the models rendered them the(he knows not whether perhaps how far he may be
allowed to pursue warranted in adding the personal knowledge acquired by them of the proposed conspirator
and his intended successor in the course of the negotiation), had lessened

had to stipulate for such a clause to the effect in question. Mr White,

Mr Bentham, now it is it being now it is proposed to him, certainly can not
object to it, but he hopes it will not appear unreasonable on
his part to stipulate for the clauses of referencemodification of it by the arbitration therefore proposed. Mr Sollr Genl
should he be of that opinion, will be pleased to insert the clause
in the above words or such better words as may occurr to him in preference.
It surely can not be necessary to refer upon even after this modification preference. the matters back to
Mr Pitt and & Mr Long certainly can not object to it, since even after the most the clause for their consent to the modification
given to the Treasury will after the proposed modification be so much more since the power which it leaves untouched is much more
than they expected or required.
