That if at any time during the continuance of
such Lean any plan should be formed by the sd
Jery & Saml Bentham or the longer liver of them respectively
for the erecting a House or Houses on the whole
or any part of the said premises then & in such
case at any time after the expiration of six
Calendr months after notice given thereof in writing
to the said B. Hodges his Exers or Admers it shall
be lawful for the said J & S Bentham or the longer
liver of them respectively to enter upon the said
premises and immediately upon such entry such
Lean shall become void as to the whole of the said
premises or as to such part or parts thereof as
may be expressed in such notice & the actual
possession thereof shall again become vested in the
sd J & S Bentham or the longer liver of them
respectively. And thereupon if after the expiration
of such notice the said B Hodges his Exers or Admers
should continue in possession of the whole or any
part of the said premises specified in such notice
he or they respectively shall be taken & considered so to do no
otherwise than as Bailiff or Bailiff of them the
sd J & S Bentham or the longer liver of them respectively
as aforesaid.

Always understood that
if without applying the premises or such resumed
part thereof to either the said purport the said
J & S Bentham or the longer of them respectively
should either grant or permitt the occupation
thereof to any other person they or the longer liver
of them respectively shall remain responsible to
the said B Hodges his Exers or Admers to the full
amount of his or their damage by reason of such avoidance
of such Lean.

Provided also that if in
virtue of any such notice as above given for
the purpose of applying the said Land to either
of the two uses abovementioned, viz for the erection
of a Penitentiary House or for Building upon
the said B. Hodges his Exers or Admers should be called upon to quit
his Exers or Admers
