the said premises before the regular expiration of
his said term as aforesaid, the said J & S Bentham
or the longer liver of them respectively hereby
agree previous to the making such resumption
to pay to the said B. Hodges his Exers of Admers
such sum not exceeding Two hundred Pounds
as shall by two Surveyors, one to be appointed by
each of the said parties with power in case of
disagreement to appoint an Umpire, be awarded
as an adequate compensation by reason of any loss
that may be sustained in consequence of the
relinquishment of such term as shall then
remain unexpired in the said Premises – It
being understood between the said parties to their
presents that no buildings of any description
are to be erected upon the said premises or in
case any buildings should be erected no allowance
is to be made for them in the making any
such award as aforesaid – And immediately upon
the payment or lawful tender of such sum
as may be awarded as aforesaid the said
B. Hodges for himself his Exers or Admers doth
hereby agree to quit the said Premises.
Provided also that in case any plan as above should
be formed for building upon the whole or any part
of the said premises the said B. Hodges his Exers
or Admers shall have the refusal of a part of the
said part of the said premises viz namely of
that part that lies immediately contiguous to the sd Distillery & Garden Ground
behind the same now likewise held by the sd B Hodges of the sd J & S Bentham,
the part which extending the whole length of the sd Distillery & Garden-Ground & being in breadth
from the same 76 feet – And it is hereby further understood & agreed that in
such Lean so to be granted by the sd J & S Bentham or the longer liver of them
respectively shall be inserted, together with the Covenants above specified, such
other Covenants as are usually inserted in Leans of such like Premises And in
the meantime, & untill such Lean shall be granted, it is hereby agreed that
the sd B. Hodges his Exers or Admers shall in like manner at the Costs &
Charges of the said J & S Bentham or the longer of them respectively upon like
demand on their parts, accept such Lean from them or the longer liver of
them respectively as aforesaid.
